4. Quotes, Payments, and Billing
All quotes are valid for 30 days from the date of issue unless stated otherwise
Payments are due as per the schedule outlined in your invoice or service agreement
Unless otherwise agreed in writing, work may be paused or suspended on accounts with overdue invoices
All fees are exclusive of applicable taxes, which will be charged as per Indian law and, where applicable, the laws of your jurisdiction
Payments made are non-refundable except where expressly stated in your service agreement or required by law
5. Client Responsibilities
To enable us to deliver services effectively, you agree to:
Provide accurate, complete, and timely information, content, credentials, and approvals as reasonably required
Ensure that any materials you supply (text, images, logos, videos, data) do not infringe the intellectual property or other rights of any third party
Maintain your own backups of any credentials, accounts, and data you share with us, unless backup services are expressly included in your engagement
Review and approve deliverables within the agreed timelines
Delays in providing required inputs may result in adjusted project timelines, and Kavcom Expert shall not be liable for such delays.
6. Intellectual Property
All content on this Website, including text, graphics, logos, designs, case studies, and software, is the property of Kavcom Expert Private Limited or its licensors and is protected by applicable copyright and trademark laws.
For client engagements:
Upon full and final payment, ownership of final deliverables transfers to the client as specified in the service agreement
Kavcom Expert retains ownership of pre-existing tools, frameworks, templates, processes, and know-how used in delivering the services
Unless a client requests otherwise in writing, Kavcom Expert may reference completed work in its portfolio, case studies, and marketing materials
7. Third-Party Platforms and Tools
Our services often involve third-party platforms such as Google, WordPress, Shopify, Meta, LinkedIn, YouTube, hosting providers, and analytics or marketing tools. Kavcom Expert does not control these platforms and is not responsible for:
Changes to their algorithms, policies, pricing, or features
Downtime, data loss, or account restrictions imposed by those platforms
Results affected by third-party platform behavior
Your use of third-party platforms is subject to their own terms and policies.
8. No Guarantee of Specific Results
Digital marketing outcomes, including search rankings, traffic, leads, engagement, and revenue, depend on many factors outside our control, including search engine algorithms, market competition, and your own business operations. While we apply industry best practices and work diligently toward agreed goals, Kavcom Expert does not guarantee specific rankings, traffic volumes, lead counts, or revenue outcomes unless expressly stated in a signed agreement.
9. Confidentiality
Both parties agree to keep confidential any non-public business information shared during an engagement, including strategies, credentials, pricing, and client data. This obligation survives the termination of any engagement. Detailed confidentiality terms, where applicable, are set out in the service agreement or a separate non-disclosure agreement.
10. Limitation of Liability
To the maximum extent permitted by law:
Kavcom Expert shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to the use of this Website or our services
Our total aggregate liability for any claim arising from an engagement shall not exceed the total fees paid by the client to Kavcom Expert for the specific services giving rise to the claim in the three months preceding the claim
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Kavcom Expert Private Limited, its directors, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:
Your breach of these Terms
Materials or instructions you provide that infringe third-party rights
Your misuse of the Website or deliverables
12. Termination
Either party may terminate an engagement in accordance with the notice terms in the applicable service agreement. Upon termination:
All outstanding invoices for work completed become immediately payable
Deliverables paid for in full will be handed over to the client
Access credentials shared during the engagement will be returned or revoked
We may suspend or terminate access to the Website at any time without notice if we reasonably believe these Terms have been violated.
